The Company reserves the right to modify, expand, or discontinue any service offering at any time, with or without notice. Specific service terms may be outlined in a separate Service Agreement or Statement of Work.
3. User Eligibility and Accounts

To use our services, you must:

  • Be a legal resident or authorised business entity operating within the United States
  • Have the legal authority to enter into binding contracts
  • Not be prohibited from receiving services under applicable U.S. law
  • Provide accurate, complete, and current registration information
Account Responsibilities
If you create an account with Blue P Marketing LLC, you are solely responsible for:

  • All activity occurring under your account
  • Notifying us immediately of any unauthorised access or security breach

4. SMS / Text Message Marketing Terms

These SMS terms are designed to comply with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and 10DLC carrier registration requirements in the United States.
📲 Consent
By providing your mobile phone number and opting in to receive SMS communications, you expressly consent to receive recurring automated and manual text messages from Blue P Marketing LLC. Consent is not a condition of purchase.
📨 How We Send SMS
Messages may be sent via registered 10DLC long codes using approved messaging platforms. Messages may include promotional offers, campaign updates, service notifications, and marketing content relevant to your opt-in.
🔁 Message Frequency
Message frequency varies based on your subscription level and campaign activity. You may receive up to 4–8 messages per month unless otherwise specified at opt-in. Recurring messages will be clearly identified.
💰 Rates & Charges
Message and data rates may apply. Standard carrier messaging and data rates charged by your mobile carrier apply to all SMS messages sent and received. Blue P Marketing LLC is not responsible for carrier charges.
To opt out at any time: Reply STOP to any SMS message you receive from us. You will receive a single confirmation message and no further messages will be sent. To re-subscribe, text START. For help, text HELP or contact us at the address below.
Blue P Marketing LLC will honour all opt-out requests promptly and in compliance with applicable telecommunications regulations. Opt-out requests submitted via STOP will be processed within 24 hours.
5. Intellectual Property Rights
Our Intellectual Property
All content on our website and within our services — including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software — is the exclusive property of Blue P Marketing LLC or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws.

Limited Licence to Users

7. Prohibited Activities

Violation of any prohibited activity policy may result in immediate account termination and potential legal action. Blue P Marketing LLC actively monitors for abuse and reserves all legal remedies.
You agree that you will not, under any circumstances, engage in any of the following activities in connection with our services:
Legal & Compliance Violations
  • Sending unsolicited commercial messages (spam) to any recipient
  • Violating the TCPA, CAN-SPAM Act, or any applicable state or federal telemarketing law
  • Collecting or harvesting phone numbers or email addresses without lawful consent
  • Engaging in deceptive, misleading, or fraudulent marketing practices
  • Impersonating any person, business, or government entity
Technical & Platform Abuse
  • Attempting to gain unauthorised access to our systems or networks
  • Introducing malware, viruses, or malicious code of any kind
  • Reverse engineering, decompiling, or disassembling any part of our platform
  • Using automated bots or scrapers to access our website without permission
  • Circumventing or attempting to circumvent any security measures
8. Payment Terms and Billing
Fees and Invoicing
All fees for services provided by Blue P Marketing LLC are outlined in your Service Agreement, proposal, or order form. Fees are due in U.S. dollars and are payable according to the schedule specified in your agreement (monthly, quarterly, or project-based).
Payment Methods
We accept major credit cards, ACH bank transfers, and other payment methods as mutually agreed upon. By providing payment information, you authorise Blue P Marketing LLC to charge applicable fees to your designated payment method.
Late Payments
Invoices not paid within 30 days of the due date may incur a late fee of 1.5% per month on the outstanding balance. Blue P Marketing LLC reserves the right to suspend services for accounts with overdue balances.
Refund Policy
All fees are generally non-refundable unless otherwise specified in a written agreement. Disputes regarding charges must be submitted in writing within 15 days of the invoice date. We will review all disputes in good faith.
9. Cancellation and Termination
Cancellation by You
You may cancel your service subscription or agreement at any time by providing written notice to Blue P Marketing LLC in accordance with the notice provisions in your Service Agreement. Standard notice periods of 30 days apply unless otherwise agreed in writing.
Upon cancellation, you remain responsible for all fees accrued up to and including the effective cancellation date. No pro-rated refunds will be issued for partial billing periods unless specifically agreed.
Termination by Us
Blue P Marketing LLC reserves the right to suspend or terminate your access to our services at any time, with or without cause, including but not limited to:
  • Breach of these Terms of Service
  • Non-payment of outstanding fees
  • Engagement in prohibited activities
  • Actions that may expose us to legal liability
Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination shall remain in full force and effect.
10. Limitation of Liability

The following limitation of liability provisions are an essential part of this agreement. Please read carefully.
To the fullest extent permitted by applicable law, Blue P Marketing LLC, its members, managers, employees, agents, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of our services, including but not limited to:
Lost Profits
Loss of revenue, income, profits, or anticipated savings
Data Loss
Loss or corruption of data, content, or information
Business Interruption
Service outages, downtime, or interruption of business operations
Third-Party Actions
Acts or omissions of third-party platforms, carriers, or service providers
In no event shall Blue P Marketing LLC's total aggregate liability to you exceed the total fees paid by you to Blue P Marketing LLC in the three (3) months immediately preceding the event giving rise to the claim.
11. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Blue P Marketing LLC does not warrant that:
  • Our services will be uninterrupted, timely, secure, or error-free at all times
  • Results obtained from using our services will be accurate, reliable, or meet your specific expectations
  • Any errors or defects in the services will be corrected within a specific timeframe
  • Our services or the servers that make them available are free of viruses or other harmful components
Digital marketing results, including SMS campaign performance, advertising outcomes, and affiliate revenue, are inherently variable and subject to market conditions, platform policies, and consumer behaviour beyond our control. No guarantee of specific results is made or implied.
12. Governing Law and Dispute Resolution
Governing Law
These Terms of Service and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
Blue P Marketing LLC is a Delaware Limited Liability Company and operates in compliance with all applicable Delaware state and U.S. federal laws.
Dispute Resolution
Any disputes, claims, or controversies arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.
If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), with proceedings to be conducted in the State of Delaware. You waive any right to participate in a class action lawsuit or class-wide arbitration.
